Ok..
anybody our there that can answer my question?
I have a 3 year odl daughter with my partner that is biologically hers. The father is NOT on the birth certificate, and we have a living trust giving me guradianship if anything happens to my partner.
We plan on going on the cruise next march, and are getting ready to go do passport pictures for a possible out of country trip later this year.
My question .. does her dad have to be a part of this at all, since he isnt even on the birth certificate? and is there any way that i can be put on their as another legal guardian?
If he has to sign something we are doomed. He will ruin it for us... AHH the lovely life we weave:)

if he is not on the birth certificate he doesn't have to sign.

No worries, my daughter was artificially conceived and there is no father on the birth certificate. You only need your info to get her a passport if there is no name listed on the birth certificate. It did confuse the lady at the passport office a bit that my daughter does not have a father but there was nothing she could do......

I have both my wifes name and my name on the birth certificate. We went to a lawyer and she legally adopted him. It is called a second parent adoption.

So, what about getting My information on her passport. I cannot legally adopt her without his consent,,, even though he is not in her life... and he will not do it. Some real words that i could say about him... but I will abstain.
Will the passport agency allow me to put my information onto her passport too so I am allowed to take her out of the country even if bio mom does not come?

I don't think so. When we applied for my daughter's passport, we brought the birth certificate and adoption papers with us and asked the woman at the government center how to fill out the form. She finally decided that we should fill it out to match the birth certificate, which says mother and adoptive mother.
BTW, the passport does not have the parent(s) name(s) listed. It's only on the application. You should talk to a lawyer to get better advice than I can give. My thinking is that your partner will need to apply for the passport, without the father, as he is not on the birth certificate. Then she should write an letter, and have it notarized, giving you permission to take"her" child out of the country and giving you authority to make decisions on her behalf in the case of a medical emergency. Again, check in with a lawyer on this to make sure that you have all of your bases covered.

I agree with Jan on this...
Your partner (bio mom) will have to apply with your daughter as her dependent. You will not be able to be on the application since you have not adopted and are not on the birth certificate.
As far as traveling with her without your partner...I too, agree that you should contact an attorney to find out what paperwork you need to do this. I am sure there are workarounds...and, I am sure that this happens occasionally.
Although the parents are not LISTED on the physical passport, the passport has a scanner ID that provides all of the detailed information...sort of like a credit card. I think it is used in some countries, but not all.

Im a worry wart and want to make sure everything is done and in place before we go anywhere.!!
Anyone else planning on doing the Mexico cruise next march??? I did one about 15 years ago and LOVED it... Have never gone through Hollan America cCruise.. but they look nice.. check em out online..

I think the requirement is that you have a notorized letter stating you have permission to take her out of the country.
Schools do it all the time, when students go to other countries for Band, Sports etc.
My nephew just went to Japan with his school band, my brother signed a release form allowing another parent to seek medical care if required. Another giving the school permission to take him.
But, if you're not on the birth cert. as parent or adoptive parent. Your info can not be on her passport. Fortunetly California is one of the 5 states that allows same sex adoptions.

I'm confused Stef, if he isn't on the birth certificate, how can he stop you or anyone else from adopting her? What rights does he have if he isn't listed on the BC? Have you talked to an attorney about trying?
